Personal Interview of a Friend Essay -- Interviews essays research pap

I interview my friend, Tim F. Mr. F was born on January 08, 1976 Cleveland, Ohio to M. J. and J. F. Mr. F. prefers to be addressed as Tim. He is mixed, Tim’s mother is mixed with black and white and his father is black. His dad left them when he was twelve years old but still came around every now and again. She remarried when he was eighteen. He is an African American male at the age of twenty-eight. He came from a middle class family, but his had more money than she leaded him believe. He was an only child but he had plenty aunt and uncles to go around. His mother came from a big family. She had three older brothers, two younger sisters and a younger brother. She was the middle child. Having three older brothers they always were harder on her she said, because she was the oldest of the younger girls. That’s why he felt that his mother was so hard on him. Mr. F is a kind-hearted person. I thought I knew Mr. F very well until I did this interview. He showed a side that I never knew he had. Mr. F attends New Harvest Church. Mr. F currently stays here in Montgomery, Alabama with his daughter Nicole. Instead of going to college Mr. F joined the Marines at the age of twenty-three. He wanted to make a better life for his self because he said that he was going to end up dead or in jail and that is two places that he did not want to be. Mr. F felt like the Marines would be the best route to not only developing him into manhood but also providing him with the best thing to do. â€Å"I wanted to be a better person and open up doors of opportunity for myself. I wanted to provide for my family, buy a house and be able to live comfortably. During the four years he was in the Marines, Mr. F traveled thought the United States and around the world to Japan, Australia, Korea, Panama and the Philippines while traveling he was available to get numerous certification in computer programming.   Ã‚  Ã‚  Ã‚  Ã‚  Mr. F lives in Town Lakes in Montgomery, Alabama upper class area. He is one of a few black neighbors in the whole neighborhood. Sometimes he feels that he should have not moved out there, because he wants his daughter to feel what it is like to not be handed everything in life. Mr. F loves his daughter to no end, but Nicole’s mother on the other hand, he say he could just live without. Mr. F weakness is he gives into his daughter too easily. As a child Mr. F he often found himsel... ...the question. That is one thing that I feel that I did not do enough of, is to keep on and stay on track of the answering of certain questions. He had seemed to be in a fun mood the day we did the interview. Earlier that week he and his mother got into a disagreement about something. He did not say what it was at the time but now I know it was because Mrs. J-F was upset because she has not seen her grand-daughter in almost a year. I was pleased to that he agreed to do the interview, after having a bad week earlier. When I told him that I would be video taping him he was ecstatic. He was in a playful mood. I listened to everything my client had to say and wanted to say. I also took notes on some things that we should have talked about in our next meeting. I showed good body language to my client. He knew I was paying attention to him because I was nodding my head and restating some of his comments to him answer. Some of the things I need to work on would be is to just let him continue talking and not cut him off so much. I feel that because Mr. F and I are very good fri ends and that is why I feel that cut him off so much, but I think I can and will do much better next time.

The Tall-Tale Heart Essay -- Literary Analysis, Allen Poe, Figurative

It is one’ o clock in the morning; you are exhausted and all you wish to do is sleep. Finally, when you are able to relax, close your eyes and begin to nod off, you hear a loud creak in the floor and you suddenly wake up to bad thoughts of what this mysterious noise is. In â€Å"The Tall-Tale Heart† by Edgar Allen Poe, various techniques are used to detail an old man’s uneasiness to the slightest of sounds at night as the narrator retells his murder of the old man. Since anyone in such situation would act similarly to the old man, his fear and anxiety is no surprise to the audience; however, with Poe’s use of figurative language, selection of details and diction the old man’s nervousness is aptly portrayed and characterized. The use of figurative language serves to compare what the narrator sees and hears to something more relatable for the reader. Poe uses several examples of similes and personifications, but only a few correlate to the well-being of the old man. As the narrator waits for the right moment to kill the old man, he notices the sound of the beating heart of the old man. Poe writes â€Å"†¦there came to my ears a low, dull, quick sound, such as a watch makes when enveloped in cotton,† to further explain in detail exactly what the narrator heard (line 50-1). The comparison between the beating heart and the muffled clock serves as an exaggeration of a racing heart during time of fear and over excitement. The swiftly beating heart also contributes to the trepidation that continues to become greater and greater in the old man, as demonstrated in Poe’s personification of â€Å"fears had been ever since growing upon him† (line 21-2). Another added factor to the old man’s fear is that the old man had been visited by Death, who... ....† The word â€Å"enveloped,† taken from the Old French word voloper meaning to wrap up, is defined as concealing something, it can be inferred that Death will take the life of the old man. But using â€Å"enveloped† as supposed to its synonym â€Å"surround† gives the action a scary feel to it. The use of diction is most important when defining the old man because without the right words to describe the situation, all meaning and purpose of the story is lost. This spine-chilling and sinister plot is only effective if Poe uses the appropriate and proper literary elements, which he has done. Poe is able to impact the reader and future readers to possibly think twice about mysterious and unusual noises heard in the night. Hopefully in the future, if ever you hear an eccentric noise when you sleep, you will remember the fate of the old man, and be wiser than he was.

Rainy Days

Rainy Days Essay By Taylor Chance 11/20/13 Rainy days are wonderful to me. Sometimes they can be a hassle but I still love them. The only time I usually have rainy days is when it is July though. Rainy days are awesome to me sense I can do a lot of things in my own house. The reasons why I like rainy days mainly is because I can sing, listen to music, relax, and eat comforting food. First of all, the reason I like rainy days is because I love to sing.During my rainy days sense the air is usually moist and the temperature is usually cold, it is my favorite time to practice. The climate actually helps my voice by making it very moist instead of dry. If I sing with a dry throat, it will damage my vocal chords and it would also damage my tonsils since I would be straining my voice. So I like to play it on the safe side and practice the most on rainy days. Nonetheless, I love to listen to music on rainy days. I mostly listen to sad or calm music because it relaxes me and brings out my emo tions.It gets even better when I look out the window and I see the gloomy, wispy, and foggy roads and the grasshoppers, birds, and squirrels take cover under big, green trees or leaves with dew from the rain on them as I see the whitish, greyish rain splatter all over the place. My favorite song that I like to listen to most is called â€Å"How to Avoid the Sun† by Bi Rain; it is one of the most beautiful songs I’ve heard or at least one of the nicest songs I’ve listened to.Music also makes me realize new things and wonder about the world especially when it is raining. Another reason is that I love to relax during rainy days. Hearing the pitter patter of the raindrops going on the ground while there is loud thunder as little cool, white or yellow strikes in the sky that looks like a crack in the dark, grey clouds called lightening flash all over the place. I could just flop down on my bed and cuddle under my warm, soft blankets to be nice, cozy, and comfy.Anothe r thing I like to do is take a nap to the sounds of the rain or daydream. It makes me feel like it is winter or something because the cold temperature also relaxes me. Finally, the last reason I love rainy days is because I can eat as much fattening food as I want. Ice cream, hot chocolate, tea, you name it and I will eat it. Eating is one of my favorite things to do even though I do not eat a lot. These are my comfort foods during rainy days to also help me relax.The taste of the creamy, doughy ice cream tickles my taste buds and gives me a brain freeze sense I eat too fast because cookie dough ice cream is my favorite; the hot chocolate is sweet, warm, and it’s warmth makes me feel nice and cozy; and my tea is one of my favorites even though it is healthy. I usually drink tea warm and unsweetened because I try to stay skinny at the same time and my favorite tea is either Darjeeling or Tao: lemon grass and green tea but, these are the reasons why I love rainy days.

Indication of a schools capabilities Essay

The current era’s education is known to be defined by students themselves, including their academic success, the value of educators and instructional quality in America, learning standards adopted by each individual state, anxiety, the role played by parents outside of a school setting, and much more. Most Americans believe that student’s standardized test scores are the only legitimate indicator of a school’s efficiency. Since 1965, when the United States Elementary and Secondary Education Act became a law, standardized testing has been used to evaluate American public schools. The ultimate goal of standardized testing is to examine how well teachers are preparing students and to improve student achievement. Some people would argue that standardized testing accomplishes the goal of examining educators, allowing them to better their skills for the future, while others would argue that the idea of standardized testing damages the educational system altogether. The leading debate that concerns most, but is brushed off by many, is whether the success of standardized testing should be used to indicate a student’s, teacher, and/or school’s capabilities. The key objective of the American educational system is for every student to graduate from high school, college and career ready. In 1959, when Everet Lindquist launched the _American College Test_ (ACT), it was â€Å"designed as a test of student’s general educational development and could be used with other criteria to predict student success at the college level.† After the launching of this well-known assessment, testing was being put in use in many educational settings. In 1954, as a part of President Lyndon B. Johnson’s, _†WAR ON POVERTY†_ , the _Elementary and Secondary Education Act_  _(ESEA)_ was introduced. This act was reauthorized in 2001, which is now known as _No Child Left Behind_ _(NCLB)_ . This reauthorized act â€Å"requires states to develop assessments in basic skills. States must give assessments to all students at select grade levels in order to receive federal school funding.† Race to the Top was introduced by President Barack Obama in 2012, which is a school district competition across the United States. This initiative was put forth to raise standards, with the goal of college and career readiness. In addition, Race to the Top has lead states to develop â€Å"rigorous standards and better assessments†, â€Å"support teachers and school leaders to become more effective†, and provide intervention for low performing schools. (Whitehouse.gov) Now that Race to the Top has become worldwide, it has become a controversial topic. Civil Rights organizations have argued that â€Å"federal funding should be based on need, not competition.† As a result of the Race, teachers will be evaluated in relation to their students test scores. In a Huffington Post, updated in 2011, research professor and author Diane Ravitch stated that â€Å"it will make the current standardized test of basic skills more important than ever, and even more time and resources will be devoted to raising scores on these tests.† The new era of Race to the Top will cause the importance of standardized testing to increase, and the demand for privately managed charter schools to increase. In June of 2010, â€Å"North Carolina adopted the Common Core State Standards in K-12 Mathematics and K-12 English Language Arts.† Beginning in 2012-13, the course of study was implemented in public schools across the state. In conjunction with these standards, â€Å"common exams† were put into effect. â€Å"†Common exams† or â€Å"Measures of student learning† refers to new assessments being developed to measure teacher effectiveness.† A teacher’s effectiveness can reflect on how well a student performs on his or her exams. Since teachers are not told what is on exams or standardized tests such as this, they must prepare their students based on the standards put forth by the state and assume it will be the same material when testing. A common exam is â€Å"given in classes where students are not given an end of grade or end of course tests† and is â€Å"created by local educators and the North Carolina  Department of Public Instruction to show the impact of teacher performance on student learning.† The success of these standardized tests â€Å"provides students with feedback on their knowledge and skills† (Astro.Temple.edu). On the other hand, it â€Å"motivates teachers to identify their areas of strength and weakness in teaching plans so that they can reconstruct them† (Astro.Temple.edu). This forms a relationship between teacher performance and student learning. On the other hand, many parents, students, as well as educators believe that standardized testing isn’t a great indication on a student’s knowledge. Standardized testing evaluates a student’s performance in one day, excluding any external factors. Many teachers are known to â€Å"†teach to the test† which can hinder a student’s overall learning potential† (Office of Work/Life Columbia University). There are many students who â€Å"are smart and understand the content, but it doesn’t show on the test. Many students develop test anxiety which hinders performance† (Office of Work/Life Columbia University). For federal funding, schools depend on their student’s to perform well. â€Å"Competition among schools† can sometimes take place (Office of Work/Life Columbia University). This could be a hard factor to overcome, when schools have exceptional and special education students. Special education include â€Å"individual or small group instruction, curriculum or teaching modifications, assistive technology, transition services and other specialized services such as physical, occupational, and speech therapy† (CHADD: National Resource Center on ADHD). Students that are considered â€Å"exceptional† are required to take the same standardized test as student without learning restrictions, so how exactly is someone at a lower level given such high standards? The Individuals with Disabilities Education Act, enacted in 1990 and reauthorized in 1997 and 2004, was designed to â€Å"ensure services to children with disabilities throughout the nation† (idea.ed.gov US Department of Education). This was designed to ensure that all student, ages 3-21, receive appropriate education regardless of any disability. In addition to this, the  disability they are diagnosed with must â€Å"affect his or her educational performance and must need special education in order to receive an appropriate education† (CHADD: National Resource Center on ADHD). â€Å"Many children in exceptional children’s programs have physical, mental, or social disabilities. In North Carolina, these academically gifted children are classified as EC, because they have different educational needs than the average child† (Exceptional Children UNC School of Education). Since No Child Left Behind was passed, â€Å"students with disabilities must be included in state testing and assessed against the same standard of proficiency as other students to determine whether schools are making the required â€Å"adequate yearly progress† towards goals for academic proficiency. The regular assessment is given to students with special needs, and they are given appropriate accommodations. Appropriate accommodations include extra time to take the test, larger print, a quiet room, Braille, having the instructions repeated periodically, or more breaks than normally allowed† (Boehner 10). In addition to the special benefits granted, an Individualized Education Program, (IEP), is designed for each child with a disability. Students under this program have a customized â€Å"learning plan† on how they will be evaluated and not whether they will be evaluated. â€Å"Results from the National Assessment of Educational Progress, also known as a Nation’s Report Card, standardized test, which is used and measured the same in all states, provide useful information on the achievement and progress of students with disabilities. The results from the Nation’s Report Card show progress, as well as gaps, between students with disabilities and nondisabled students† (Aron and Loprest 112-113).

Drafting and Use of Questionnaire as a Research Tool in Legal Research Essay

Introduction The word research is derived from the Middle French â€Å"recherche†, which means â€Å"to go about seeking†, the term itself being derived from the Old French term â€Å"recerchier† a compound word from â€Å"re-† + â€Å"cerchier†, or â€Å"sercher†, meaning ‘search’. The earliest recorded use of the term was in 1577 Research and experimental development is formal work undertaken systematically to increase the stock of knowledge, including knowledge of humanity, culture and society, and the use of this stock of knowledge to devise new applications (OECD (2002) Frascati Manual: proposed standard practice for surveys on research and experimental development, 6th edition. It is used to establish or confirm facts, reaffirm the results of previous work, solve new or existing problems, support theorems, or develop new theories. A research project may also be an expansion on past work in the field. To test the validity of instruments, procedures, or experiments, research may replicate elements of prior projects, or the project as a whole. The primary purposes of basic research (as opposed to applied research) are documentation, discovery, interpretation, or the research and development of methods and systems for the advancement of human knowledge. Approaches to research depend on epistemologies, which vary considerably both within and between humanities and sciences. In lay man language research means search or find those things which are already in existence. Research work is not something which can be completed in one stroke or in one step. It consists of a number of closely related activities which very often overlap, and therefore, it becomes difficult to ascertain where one step ended and the other began. However, it is important to keep in mind that various steps are not mutually exclusive, nor they are totally separate and distinct. What step should be followed at what time depends on the research . However, the following guide-lines in this regard are significant: 1. Formulation of researcher problem- At the very outset the researcher must choose the area in which he wants to carry on research. In the field of law the researcher has a very wide scope. After selecting the area we are required to select specific topic or subject for the study. Thus formulation of a general topic into a specific researcher problem constitutes the first step in this regard. It can be said that formulation the researcher problem involves two steps: a) Understanding the problem thoroughly: and b) Re-shaping that understanding into meaningful terms to arrive at a concrete result. Thus formulation of research problem is very significant for a researcher and if it is done successfully, a good deal of battle is won. 2. Extensive literature survey- Once a problem is formulated a brief summary of it should be prepared. For this the researcher must undertake an extensive survey of the available literature on the subject: preferably connected with the problem. For this purpose the abstracting and indexing journals, published and unpublished bibliographies should first of all be examined. Academic journals, conference proceedings government reports, reference books and text books, depending on the nature of the problem must be seen. 3. Formulation of hypothesis- When the literature relating to the problem is extensively surveyed researcher should state in clear terms the hypothesis. A hypothesis is the tentative assumption made in order to draw out and test its logical consequences. In its most elementary stage the hypothesis may be any guess, imagination ideas which becomes the basis for action or investigation. It helps in the analysis of the material pertaining to the subject. It helps in delimiting the area of research and keeps the researcher on the right track. 4. Collection of material- A research cannot be said to be duly carried out unless the relevant materials have been examined. But the relevant cannot be examined unless and until they have been collected and compiled. The collection of the relevant materials is most difficult and comprehensive work and requires lot of energy and attention as well as patience. 5. Analysis of material- Once the requisite materials are collected, the researcher undertakes to analyse them. This is also a very important step in the direction of fulfilment of research work. In case of doctrinal research the researcher can proceed smoothly if he is well aware about the principles of interpretation and construction. He is required to examine the fact of each case, the principle applied to that fact, the line of argument taken, relief sought and provided and if necessary the history or legislation, etc. There may be situations in relation to which no statutory provision existed it was decided on the basis of the principle of justice, equity and good conscience. If the bulk of the examined material indicates to a particular direction, the principle so applied should be accepted as general principles and principles not applied should be deemed to have been overlooked. 6. Testing of hypothesis- After analysis of materials or data as the case may be the researcher becomes confident enough to test his hypothesis which he had already formulated. He can examine if the material or data after analysis support his hypothesis or they are contrary to it. The hypothesis testing ultimately results in either accepting the hypothesis or in rejecting it or in making amendment in it. 7. Generalisation and interpretation- The research work whether doctrinal or non-doctrinal will proceed towards generalisation and interpretation if the hypothesis has been tested positive. If it results in negative the question of generalisation and interpretation does not arise. The purpose of generalisation and interpretation is to built up a theory to be applicable in future to adjudicate upon similar and identical problems. This process of generalisation and interpretation, while helping in formulation of a general theory, also raises many important question which may lead to further research and till those question are answered they may be regarded as exceptions to the general theory or principle thus build up. 8. Preparation of report- The penultimate task in a researcher work is to write the report of the exercise done so far. It should be prepared with great care and caution because it is this report that gives credit to the researcher. Objective of research are following: i. To familiarize with a phenomenon or to acquire new insights into an existing fact, that is, Exploratory Research. ii. To determine the frequency with which something occurs or with which it is associated with something else, that is, Diagnostic Research. iii. To portray accurately the characteristics of a particular object, situation or group, that is, Descriptive Research. iv. To test a hypothesis of a causal relationship between two objects, that is, Hypothesis Testing Research. v. To separate fact from speculation and wish, that is, Distinguishing Research. Definition- Research has been defined in a number of different ways. A broad definition of research is given by Martyn Shuttleworth – â€Å"In the broadest sense of the word, the definition of research includes any gathering of data, information and facts for the advancement of knowledge.† Another definition of research is given by Creswell who states – â€Å"Research is a process of steps used to collect and analyse information to increase our understanding of a topic or issue†. It consists of three steps: Pose a question, collect data to answer the question, and present an answer to the question. The Merriam-Webster Online Dictionary defines research in more detail as â€Å"a studious inquiry or examination; especially : investigation or experimentation aimed at the discovery and interpretation of facts, revision of accepted theories or laws in the light of new facts, or practical application of such new or revised theories or laws†. The Encyclopaedia Britannica (1911 edition) defines research to mean- â€Å"the act of searching into a matter closely and carefully, inquiry directed to the discovery of truth and in particular the trained scientific investigation of the principles and facts of any subject, based on original and first hand study of authorities or experiment. Investigation of every kind which has been based on original sources of knowledge may be styled research and it may be said that without ‘research’ no authoritative work have been written, no scientific inventions or discoveries made, no theories of any value propounded†. This definition is probably most exhaustive and meaningful. Meaning and Objective of Legal Research- ‘Legal research’ means research in that branch of knowledge which deals with the principles of law and legal institution. There are three main sources of law, that is, legislation, precedent, and custom. Juristic writings are another important though secondary source of law and their important is dependent on the fact whether it is given due recognition by the courts or the legislature or jurists in solving problems or not. The contents of these sources of law change with the changing requirement of the society and if these changes are not taken into account in interpreting the law, the existing law is bound to be doomed. The aim of law is, therefore, to regulate the human behaviour in the present day society and hence, legal research must be directed to the study of the relationship between the world of the law and the world that the law purports to govern. Generally, law is enacted to regulate the human conduct for the welfare of humankind. It is considered that law should be enacted to protect the interest of a person, society, and the county as a whole. The goal of legal research cannot be distinguished from the goal of law. As law is directly related with the social science, its research is also automatically related with the research of social science. This is the age of democracy and good governance. Democracy and good governance depend upon the rule of law. In democratic society, law is changed for welfare of the people and society along with the pace of time. Alternatively, law shall not be constraint for the development rather it be facilitator. That is why law needs charges. Similarly, legal research is essential to have changes in law for socialization and betterment of the people and society. Now-a-days, legal research is not limited only on the analysing of criminal behaviour, activities of public, court, public prosecutors, legal practitioners etc. but it also includes the protection of environment of all creatures in the world and the development as well. As a result, legal research plays crucial role for the welfare of the humankind and is more important than others to bring positive changes in our society and at the end in the whole humankind. The following are the objectives of legal research- i. To discover new facts; i. To test and verify old facts; ii. To analysis the facts in new theoretical framework; iii. To examine the consequences of new facts or new principles of law; or judicial decisions; iv. To develop new legal researcher tools or apply tools of other disciplines in the area of law; v. To propound a new legal concept; vi. To analyse law and legal institutions from point of view of history; vii. To examine the nature and scope of new law or legal institutions; viii. To ascertain the merits and demerits of old law or institution and to give suggestion for a new or institution in place of old one; ix. To ascertain the relationship between legislature and judiciary and to give suggestion as to haw one can assist the discharge of one’s duties and responsibilities; and x. To develop the principles of interpretation for critical examination of statutes. These objectives of legal research as of any other research may be obtained by any of the following processes: i. Evolutive; or ii. Explicative; or iii. Identificatory; or iv. Projective; or v. Collative; or vi. Impact analysis; or vii. Interactive; or viii. Interpretative. Evolutive process : Evolutive research is one which seeks to identify the roots of a social evil and tries to prohibit it by law, eg. Eradication of dowry , prohibition of Sati, prohibition of child marriage, legalising widow marriage, etc. historical facts play most important role in this kind of research. Explicative process- Explicative process is one which tries to ascertain the nature, scope of law in order to fxplain the nature, scope of law in order to explain what law is, e.g. law relating to industrial pollution and legal relating to administrative action and its legal control, matrimonial relief etc. Identificatory process- An identificatory process is one whose objective is to ascertain the people for whose benefit a legal is enacted e.g. research carried on to find out the beneficiaries of land reform, beneficiaries of reservation among Scheduled Castes and Scheduled Tribes and Backwards, the group of industrial establishments kept out of the area of operation of a piece of legislation, e.g. activities outside the area of the Factories Act, 1948, industrial establishments not covered by the Provident Fund Act, etc. employees entitled to the benefit of provident fund and insurance fund, etc. Projective Process- A projective process is one which aims at examining the degree of social acceptance to a policy the State is planning to implement. This kind of research attempts to find out at the very beginning, the mood of the people or masses, or electorate or industrial workers, whether they will accept the proposed scheme or not, or they will accept it with certain modification. Truly speaking, it is a survey beforehand rather than a research work to find out the feasibility of the proposed scheme. Collative process- A collative process is one which tries to find out the effect of existing law, in relation to other existing law, i.e. its objective is to compare the two set of rules to find out which one is more workable and by which the desired effect may be achieved. Impact analysis process- This kind of research is carried on to find out the impact of an established or newly formed legal principle, rule or institution. In the area of planning this kind of study assumes much significance. On the basis of the outcome of the research necessary changes may be made wherever necessary it helps us to change our outlook towards the objective sought to be achieved, thus it is a preliminary steps to law reform. Interactive process- Law does not operate in vacuum. It operates in society. There are a number of other factors, which interact with it. These factors are of various types such as formal or non-formal, permanent or transitory. A legal researcher cannot be insensitive to such factors of society which annihilate the entire fabric of law. Since law is a part of the society, therefore, the law should be such as that it can work in the society. A researcher must take care of- a) The relative autonomy of law in relation to other component of society; b) The relationship between various component within the legal system; and c) The inter-dependence of one or more components of law within the legal system. Interpretative Research process- This kind of research aims at interpreting the various words and phrases used in defining the law. The researcher makes effort to give a particular word, a specific meaning by using his own logic and authoritative opinion of other people. This kind of researcher is confined mostly to the study of statutes, text and judicial pronouncement and is done by analysing the words. It helps acquire clarity, consistency, uniformity in the meaning of legal writing. These objectives of researcher, thus, help us in determining for what purpose the research is directed, and how, the research may be carried on.
